1. These terms and conditions (the “Rules”) apply to the IG discounted CFD commission Promotion (the “Promotion”). By participating in the Promotion, participants agree to be bound by these Rules. All capitalised but undefined terms will be deemed to have the same meaning as given to such terms in your Margin Trading Customer Agreement.
2. The Promotion is organised by IG (“we”, “our”, or “us”) with their registered address being Level 32, Queen & Collins, 376-390 Collins Street, Melbourne, VIC 3000, Australia (“IG”).
3. This Promotion will end at 5:00pm AEST on 31st May, 2017 (the “Promotion Period”).
Eligibility
4. To be eligible to take part in the Promotion (a “Qualifying Participant”) you must fulfil the following criteria:
a) you must have both an existing share trading account and an existing contracts for difference trading account (“CFD Account”) with us; and
b) you must place at least one share CFD trade with us before the end of the Promotion Period.
5. You will not be eligible to participate in the Promotion if you are an employee (or any relation or partner or agent of an employee) of IG.
6. You will not be eligible to participate in the Promotion if, at the commencement of the Promotion, you do not already have both a share trading account and a CFD account with IG.
Promotion Details
7. If you are a Qualifying Participant, all online share CFD trades will be charged at 50% of IG’s standard applicable commission rate during the Promotion Period, subject to the following:
a) your first share CFD trade must be placed during the Promotion Period, i.e. you must not have already placed a share CFD trade with IG;
b) our standard commission rates will apply the day after the last day of the Promotion Period (please see our website for IG’s standard commission rates); and
c) the Promotion does not apply to trades placed by phone.
8. By accepting and proceeding with this Promotion, you have agreed to be bound by these Rules as well as the Margin Trading Customer Agreement and Share Trading Customer Agreement (the “Customer Agreements”) relevant to your accounts with us. If any provision of these Rules conflicts with any provision of any of the Customer Agreements, the terms of the relevant Customer Agreement shall prevail.
9. This Promotion applies to share CFD trades only. The Promotion does not apply to share trades in physical equities.
10. Wholesale clients are expressly excluded from participating in this Promotion.
11. Foreign exchange conversion fees and government taxes may apply.
General
12. We are the sole arbiter of the Promotion, these Rules and any other issues arising under this Promotion. Exceptions to these Rules are at the sole discretion of IG’s management, and our decision is final. We reserve the right to alter, amend or terminate the Promotion or any aspect of it at any time and without prior notice.
13. We will not be held liable for any losses incurred by you as a result of your trading in relation to this Promotion. Trading CFDs is a high risk activity and it is possible to lose more than your initial investment.
14. Any dispute or situation not covered by the terms of this Promotion will be resolved by our management in a manner it deems to be fairest to all concerned and that decision shall be final and binding on all parties. We reserve the right to refuse the pay out under the Promotion if we have reasonable belief that there has been any co-operation, collusion and/or organisation of transactions from the same source, or if we have reasonable belief that the Promotion is being abused in any way.
15. This Promotion and any obligations of IG pursuant to it will be revoked or withdrawn from Qualifying Participants who abuse the spirit or intention of it. We reserve the right to cancel or withdraw the Promotion or Promotion Period at any time in case of any suspected abuse of the Promotion. For the avoidance of doubt, “abuse” includes, but is not limited to, the opening of multiple IG(as applicable) accounts to claim multiple Promotion Periods. Further, where any of these Rules are breached or there is any reason to suspect a Qualifying Participant has acted fraudulently or obtained an unfair or unintended advantage pursuant to Promotion, we reserve the right to stop or withdraw the Promotion or the Promotion Period.
16. If at any time all or any part of any provision of these Rules are or become illegal, invalid or unenforceable in any respect under the law of any jurisdiction, such provision(s) shall not affect or impair the legality, validity or enforceability in that jurisdiction of the remainder of that provision or all other provisions of these Rules or the legality, validity or enforceability under the law of any other jurisdiction of that provision or all other provisions of these Rules.
17. These Rules shall be governed by and construed in accordance with the laws of Victoria, Australia and shall by subject to the jurisdiction of the Victorian courts.
