Terms and conditions: options promotion

1. You agree that by participating in the IG options promotion (the “Promotion”) you will be bound by these terms and conditions (the “Promotion Terms”) as well as the general terms and conditions in the customer agreement that apply to your CFD account with IG Markets Limited or IG Europe GmbH (“Our Terms”). Capitalised terms and expressions used in these Promotion Terms shall have the same meaning as in Our Terms unless specified otherwise in the Promotion Terms. If any provision of these Promotion Terms conflicts with any provision of Our Terms, Our Terms shall prevail.

2. The Promotion is organised by IG Europe GmbH a private limited company incorporated in Germany with registered number HRB 115624 and whose registered office is at Westhafenplatz 1, 60327 Frankfurt (‘IG’), Authorised and regulated by Bundesanstalt für Finanzdienstleistungsaufsicht with BaFin register number 148759 and Deutsche Bundesbank.

3. The Promotion commences on 22 May 2019 and continues until 23:59 on 28 June 2019 (“Promotion Period”).

ELIGIBILITY

4. To be eligible to take part in the Promotion you must:

(a) be over eighteen (18) years of age;

(b) have received an email invitation by IG only titled “Trade barriers for a €200 bonus”;

(c) hold a CFD account with IG Markets Limited or IG Europe GmbH; and

(d) applied for and opened an IG Barriers & Options account during the Promotion Period.

Any client who satisfies all of the criteria above shall be deemed a “Qualifying Applicant”.

ACTIVATION BONUS PROMOTION DETAILS

5. If you are a Qualifying Applicant, we will credit EUR200 into your IG Barriers & Options account (“Bonus”) within 2 (two) working days of you satisfying the criteria below:

(a) within the Promotion Period you must activate your new IG Barriers & Options account by completing any final account opening process or by providing any outstanding documentation as advised by IG;

(b) you must have accepted these Promotion Terms; and

(c) you must be fully authorised to operate your IG CFD and/or Barriers & Options account.

6. You must have placed at least five (5) trades within 30 days of the date your IG Barriers & Options account has been activated in order to withdraw the Bonus. If after 30 days, you have not placed 5 trades, IG shall be entitled to remove the Bonus from your IG Barriers & Options account. If you have any open positions and insufficient funds on the IG Barriers & Options account, such positions shall be at risk of immediate closure.

7. This Promotion is only valid once per person. Once you have claimed the Bonus you will not be able to make further claims in respect of this Promotion.

8. The maximum amount of the Bonus that we will pay you under this Promotion will be EUR200.

9. The IG Barriers & Options account and the CFD account must be open and not the subject of any dispute with us or in default on the date a payment becomes payable to qualify for this promotion.

10. You acknowledge that your Barriers & Options account will be governed by the terms of the Derivatives Customer Agreement.

GENERAL

11. We are the sole arbiter of the Promotion, these Promotion Terms and any other issues arising under this Promotion. Exceptions to these Promotion Terms are at the sole discretion of IG’s management, and our decision is final. We reserve the right to alter, amend or terminate the Promotion or any aspect of it at any time and without prior notice.

12. Notwithstanding any other provision of these Promotion Terms, we shall have the sole discretion to determine your eligibility under these Promotion Terms, including, without limitation, whether or not you are a Qualifying Applicant. We have the right not to accept a Qualifying Applicant for any reason or without reason as we shall determine in our sole discretion.

13. Under no circumstances will we be liable for any losses that a Qualifying Applicant may incur as a result of trading on their account(s). This Promotion is not intended to change any client’s risk preferences or investment strategies and we accept no responsibility for the same.

14. Any dispute or situation not covered by the terms of this Promotion will be resolved by our management in a manner it deems to be fairest to all concerned and that decision shall be final and binding on all parties. We reserve the right to refuse the pay out under the Promotion if we have reasonable belief that there has been any co-operation, collusion and/or organisation of transactions from the same source, or if we have reasonable belief that the Promotion is being abused in any way.

15. In the event that a person takes part in this Promotion who does not meet the qualifying criteria set out in these Promotion Terms, we reserve the right, without prejudice to any other rights under these Promotion Terms or Our Terms, to immediately remove the Promotion from the applicable account, including, without limitation, removing any credit applied to the account. In addition, we reserve the right at our sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the promotion, or who breaches the Promotion Terms or Our Terms.

16. This Promotion and any obligations of IG pursuant to it will be revoked or withdrawn from Qualifying Applicants who abuse the spirit or intention of it. We reserve the right to cancel or withdraw an offer and/or Bonus at any time in case of any suspected abuse of the Promotion. For the avoidance of doubt, ‘abuse’ includes, but is not limited to, the opening of multiple IG (as applicable) accounts to claim multiple offers and/or Bonus’. Further, where any of these Promotion Terms are breached or there is any reason to suspect a Qualifying Applicant has acted fraudulently or obtained an unfair or unintended advantage pursuant to this Promotion, we reserve the right to stop or withdraw payment of the Bonus or any attempted withdrawal of the Bonus.

17. If at any time all or any part of any provision of these Promotion Terms are or become illegal, invalid or unenforceable in any respect under the law of any jurisdiction, such provision(s) shall not affect or impair the legality, validity or enforceability in that jurisdiction of the remainder of that provision or all other provisions of these Promotion Terms or the legality, validity or enforceability under the law of any other jurisdiction of that provision or all other provisions of these Promotion Terms.

18. This Promotion and these Promotion Terms will be governed by the laws of England and Wales and the English courts shall have exclusive jurisdiction over any matter or dispute arising from this Promotion.
