Terms and conditions

  1. These terms and conditions (the “Terms and Conditions”) apply to the Ashes Series 2021-22 prize draw (the “Draw”).

  2. Participants who agree to participate in the Draw will be bound by these Terms and Conditions.

  3. The Draw is organised by IG Markets Limited on behalf of itself and other IG group companies (“IG”).

  4. The Draw will open at 12:00am UK on 6 December 2021, and will close for entries at 12:00am UK on 19 January 2022 inclusive (the “Closing Date and Time”).

  5. The winners of the Draw will win one of three Smart Portfolio accounts or Smart Portfolio ISAs with IG funded with either (i) £2, (ii) £4 or (iii) £6 for every run the England team scores during the 2021-22 Ashes Series, up to a maximum value of £5,250, £10,500 and £16,000, respectively (together, the “Prizes”, and each, a “Prize”).

  6. The Draw is open to persons aged 18 (eighteen) years or older who enter into the Draw before the expiry of the Closing Date and Time (the “Qualifying Participants”).

  7. A maximum of 1 (one) entry per person is allowed.

  8. To be eligible for a Prize, the Qualifying Participant must be eligible for either a Smart Portfolio account or a Smart Portfolio ISA with IG (as applicable) according to IG’s eligibility criteria. In entering into the Draw, you confirm that you are eligible to do so and are eligible to claim a Prize.

  9. No purchase is necessary and there is no charge for use of the website.

  10. A maximum of 3 (three) winners will be selected at random from all of the Qualifying Participants within 14 (fourteen) days of the Closing Date and Time for entries (the “Selection Date”). No Qualifying Participant can win more than one Prize.

  11. The winners of the Draw will be notified as soon as reasonably practicable after the Selection Date using the email address used to enter into the Draw. Failure to acknowledge receipt of this notification from IG within 21 (twenty one) days of receipt of such notification may result in disqualification and selection of another winner.

  12. To claim a Prize, a winner must confirm receipt of the confirmation email referred to above within the stipulated time period.

  13. Subject to these Terms and Conditions, the winners can opt to have either a Smart Portfolio account or a Smart Portfolio ISA with IG. If a winner opts to have a Smart Portfolio ISA with IG and has already used their ISA allowance for the current tax year (2021-2022), IG will invest the prize into a Smart Portfolio ISA with IG in the following tax year (2022-2023) on their behalf. The winner must notify IG about this in writing.

  14. In order to redeem a Prize, a winner must create either a Smart Portfolio account or a Smart Portfolio ISA with IG and notify IG that this has been done. The relevant account must be opened as soon as reasonably practicable and, in any event, within 21 (twenty one) days of the winner confirming receipt of the confirmation email referred to above. IG will fund the account with the relevant prize within 21 (twenty one) days from (i) being notified that the account has been opened or (ii) 6 April 2022 if a winner opts to open a Smart Portfolio ISA with IG and has already used their ISA allowance for the current tax year (2021-2022).

  15. If a winner is not eligible for either a Smart Portfolio account or a Smart Portfolio ISA with IG, they will forfeit their Prize and another winner will be selected at random from the remaining Qualifying Participants.

  16. Each Prize is non-transferable and there is no cash alternative.

  17. IG reserves the right to substitute a Prize with a prize of equal or greater value.

  18. IG reserves the right to disqualify any Qualifying Participant or not award a Prize if it has reasonable grounds to believe the Qualifying Participant has (i) breached any of these Terms and Conditions; or, if relevant, (ii) breached any provisions of the customer agreement(s) governing her/his account(s) with IG; and/or, if relevant, (iii) had her/his account suspended or closed for any reason.

  19. IG reserves the right to disqualify any Qualifying Participant or not award a Prize if it has reasonable grounds to believe that the Draw is being abused in any way.

  20. IG will not accept responsibility for Draw entries that are lost, mislaid, damaged or delayed in transit regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

  21. In the event of any dispute regarding these Terms and Conditions, conduct, results and all other matters relating to the Draw, the decision of IG shall be final, and no correspondence or discussion shall be entered into.

  22. IG shall be the sole arbiter of the Draw and reserves the right to alter, suspend, amend or foreclose the Draw and/or any Prize at any time without prior written notice and without any liability to any Qualifying Participant.

  23. If relevant, IG will not be held liable for any losses incurred by you as a result of your trading in relation to your account(s) with IG. Trading is a high-risk activity and it is possible for you to lose more than your initial investment.

  24. IG reserves the right to amend the terms of the Draw at any time.

  25. Insofar as is permitted by law, IG, its agents or distributors will not in any circumstances be responsible or liable to compensate any winner or accept any liability to any winner or Qualifying Participant for any loss, damage, personal injury or death occurring as a result of taking up a Prize and participating in the Draw except where it is caused by the negligence of IG, its agents or distributors or that of their employees.

  26. All competition entries and any accompanying material submitted to IG will become the property of IG on receipt and will not be returned.

  27. Employees of IG are not eligible for a Prize.

  29. We may share your data with third parties including with the England and Wales Cricket Board.

  30. If at any time all or any part of these Terms and Conditions are or become illegal, invalid or unenforceable in any respect under the law of any jurisdiction, such provision(s) shall not affect or impair the legality, validity or enforceability in that jurisdiction of the remainder of that provision or all other provisions of these Terms and Conditions or the legality, validity or enforceability under the law of any other jurisdiction of that provision or all other provisions of these Terms and Conditions.

  31. These Terms and Conditions are governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
